There is a moment in nearly every divorce when the financial reality becomes undeniable. One spouse recognises that years out of the workforce, a career redirected, or opportunities passed up may have left them at a financial disadvantage. The other questions what ongoing support is fair when their own financial life is also being divided and rebuilt. In cross-border cases, the questions multiply: which law applies, how tax systems interact, how currency affects any order made, and whether another court is already addressing maintenance or wider financial orders.
Provinziano & Associates handles spousal support matters for clients whose marriages and finances span both California and the UK. If needed, we coordinate with local counsel in the relevant UK jurisdiction to build a strategy that accounts for both jurisdictions’ laws and procedures.
Our spousal support lawyers handle everything from initial support requests, modifications, and enforcement to contesting, limiting, or defending against claims and orders the other side is pursuing.
We help clients prepare the financial records and legal arguments courts review when deciding temporary or long-term support handling cases at every level of complexity, from cooperative agreements to high-asset, highly contested hearings and negotiated settlements.
With 100 years of combined experience, we advocate for outcomes that reflect the financial reality you’re living now, including need, ability to pay, and each spouse’s contributions.
Call our Beverly Hills office at (310) 820-3500 to speak with a California attorney about your cross-border spousal support matter.
Spousal support in California, also known as alimony or spousal maintenance, is a court-ordered payment from one spouse or domestic partner to the other. In California, it is usually ordered in divorce, legal separation, or domestic partnership dissolution cases when one person needs time to regain financial stability and the other has the ability to pay.
California courts may order temporary support while the case is pending or long-term support after the final judgment. Temporary support helps address immediate financial needs during the case. Long-term support is decided later, after the court reviews the full financial picture and the legal factors California law requires it to consider.
In the UK, spousal maintenance is treated differently depending on the jurisdiction. Some may consider ongoing maintenance as part of a wider financial order, and whether a clean break is appropriate. Others take a more restricted approach to ongoing post-divorce support, with periodical allowance playing a narrower role. These differences shape both the strategy and the order in which proceedings are run.
Your case evaluation with our California team is free. Call (310) 820-3500 to speak with our Beverly Hills office.
Every spousal support case starts with one thing: your story. The decisions you made, the roles you played, the country you live in, and the lifestyle you want to live now. Provinziano & Associates acts for both paying and receiving spouses in California-UK support matters.
We handle each stage as it arises: initial requests, temporary orders, final determinations, modifications, enforcement, and termination proceedings.
Our experienced spousal support lawyers help clients:
You stepped back from your career, or did not start one, because the structure of the marriage called for someone to hold the household together while your spouse built their professional life, sometimes across borders. You kept the household running, raised the children, and created the conditions that made everything else possible.
We help clients like you pursue support that reflects the value of those contributions and the international life you helped build.
You spent years working long hours, taking financial risks, or shouldering the pressure that came with being the provider. Now you are being asked to continue that support in a new context, at a level that does not reflect what you actually earn, what you can reasonably pay, or what has already been addressed in related financial proceedings abroad.
Our attorneys review support demands, challenge overreach, and propose California positions grounded in your real income and obligations.
When payments stop, the impact is immediate. Rent, utilities, and basic expenses do not pause because a spouse decided to stop paying. A support order is enforceable, and we help clients pursue wage assignment, contempt proceedings, and other remedies designed to collect what is owed.
When support orders need cross-border enforcement, we handle the California side, including recognition or enforcement of UK maintenance orders in California, and coordinate with local counsel when California orders must be recognised or enforced in the UK.
What made sense at the time of the divorce may no longer reflect your life today. A job loss, a change in income, retirement, remarriage, a move between California and the UK, or a major shift in either spouse’s financial situation can affect whether the original support order still works. A change in tax residency alone can substantially alter the after-tax value of an existing order.
We help clients seek or oppose modification of spousal support orders. That may mean asking for a lower payment, requesting more support, challenging a reduction request, or addressing whether support should continue, change, or end because one spouse was expected to become self-supporting over time.
Whether you are seeking support or responding to a request, the facts of your situation determine your options. Call us at (310) 820-3500 to talk through where you stand.
Spousal support exists to address financial imbalance during or after divorce, legal separation, or domestic partnership dissolution. It is not a punishment for one spouse or a reward for the other. California courts look at whether one spouse or partner needs support, whether the other has the ability to pay, and what support would be fair under California law. Either spouse may request support, and either spouse may be ordered to pay. California spousal support is not based on gender.
Whether support is appropriate, and in what amount, depends on the specific financial circumstances of each spouse and the factors California courts are required to weigh. Support can take different forms. Periodic payments, typically monthly, are the most common. Spouses can also agree privately to a lump-sum payment or a property transfer in lieu of ongoing support.
To become binding in California, any private agreement must be submitted to the court, which will review it to confirm the terms are fair and not the product of duress or incomplete disclosure. Equivalent court oversight applies in UK jurisdictions, though the procedural route differs.
Temporary support and long-term support are calculated differently in California.
Temporary support may be estimated with guideline formulas or certified support calculator software while the case is pending.
Long-term support is decided at judgment and is not based on one fixed formula. Judges look at California Family Code section 4320 factors, such as need, ability to pay, earning capacity, marital lifestyle, marriage length, health, assets, debts, and each spouse’s ability to become self-supporting.
How much California spousal support you can receive or may have to pay depends on these factors. Tax residency, IRS and HMRC reporting, California-UK tax treaty treatment, prior agreements, currency exposure, and the existence or absence of related proceedings abroad can also affect how the California analysis plays out in practice.
For marriages under 10 years, California courts often use half the length of the marriage as a starting point for how long support may last. For marriages of 10 years or longer, the court usually does not have to set a specific end date right away. That does not mean support lasts forever. It means the court may keep the power to review, change, reduce, or end support later based on the facts.
Support may later change if major facts change. That can include job loss, retirement, remarriage, cohabitation, a major income change, the end of child support, or a relocation.
Our attorneys help clients present their side with the records, strategy, and evidence courts need to evaluate. We handle support disputes involving regular wages, variable income, business income, bonuses, commissions, carried interest, unemployment, underemployment, disputed earning capacity, and claims that one spouse is not earning what they reasonably could.
California spousal support law sets the framework. Your financial picture, your marriage, and your jurisdictional circumstances determine what it means for your case.
Our attorneys handle support disputes involving regular wages, variable income, business income, bonuses, carried interest, equity compensation, UK pension entitlements, and questions about earning capacity.
Call us at (310) 820-3500 to discuss the specifics of your case.
Understanding the type of support involved can shape the entire outcome. We make sure cross-border clients understand how the California framework maps to the UK side of their case. Our California attorneys help clients work through the following:
Spousal support can affect more than this month's payment. It can shape housing decisions across two countries, business cash flow, retirement planning, settlement terms, tax residency choices, and the financial pressure each spouse carries after divorce. We build support positions with the long-term cross-border impact in mind, so the order does not solve one problem in one place while creating another elsewhere.
Spousal support disputes can involve contested income, earning capacity arguments, long-term financial planning, and courtroom litigation. Alphonse Provinziano holds the Certified Family Law Specialist designation from the State Bar of California, awarded to attorneys who meet rigorous experience and examination requirements. That credential carries weight in cases where the financial and legal stakes are high.
A payslip does not always tell the full story, particularly in cross-border cases. When support involves business income, variable earnings, bonuses, carried interest, equity compensation, UK pension entitlements, or questions about what a spouse is capable of earning, we work with forensic accountants, business valuators, and US-UK tax professionals to make sure the income figure before the court reflects reality.
We work to resolve spousal support disputes through negotiation when possible, but we are prepared to litigate when agreement is not. With extensive courtroom experience, Provinziano & Associates brings both settlement strategy and courtroom readiness to support cases, so your position is built for either outcome.
Spousal support cases can expose tax returns, business records, income history, health issues, spending patterns, and private family details. While some court records may be public in both California and UK jurisdictions, we are careful about how information is collected, shared, filed, and presented so your case is handled with the discretion it deserves. For clients in senior corporate roles, or otherwise in the public eye, discretion is built into every step.

Going through a divorce is incredibly stressful, but working with Al and Devon made the process manageable. From our first meeting, they were professional, empathetic, and truly listened to my goals. What I appreciated most was how they helped me choose the right path to reach a fair agreement with my ex rather than pushing for a long, drawn-out legal battle. They kept me focused on the big picture and helped us reach a resolution that felt right for everyone. I highly recommend them to anyone needing expert legal divorce guidance.Posted on Google![]()

I cannot recommend my Mr. Provinziano and his associates highly enough. Al stepped into my life at one of the most fragile and overwhelming times I’ve ever experienced, and from the very beginning, he handled my case with compassion, steadiness, and exceptional skill. Navigating international family law is daunting on its own, but he took me under his wing seamlessly, explaining every step, anticipating challenges before they arose, and always making sure I felt protected and heard. His knowledge of international family law is truly impressive, and his strategic approach resulted in me receiving everything I asked for. Beyond the outcome, what sets him apart is how deeply he cared. He brought calm to chaos, confidence to uncertainty, and strength when I had very little left. I never felt like just another case , I felt supported, respected, and genuinely advocated for. If you are looking for an attorney who combines legal excellence with humanity, integrity, and unwavering dedication, I could not recommend him more highly.Posted on Google![]()

We start by looking at what support means in your specific situation: what is being requested, what feels unfair, what you need, what you can realistically pay across two tax systems, and what outcome would leave you on firmer financial ground in California, the UK, or both.
Here is how it works:
1. Private case evaluation focused on identifying the California spousal support issue and how it interacts with any UK proceedings
2. Financial review of income, expenses, lifestyle, and earning capacity, with attention to cross-border elements (currency, tax residency, UK pensions, offshore assets)
3. Support strategy for negotiation, settlement, or California court, coordinated with UK counsel where parallel proceedings exist
4. Full California representation in private negotiation, mediation, settlement conferences, court hearings, and trial
Spousal support can shape what your financial life looks like after the divorce is resolved. The attorney you choose shapes how the process unfolds: how you are positioned in negotiations and how your situation is presented to the court.
Spousal support can be one of the most complex and contested matters, so you need attorneys who understand when negotiation serves your position and when litigation does. With substantial experience handling family law cases, including high-asset matters with international dimensions, Provinziano & Associates brings experience to spousal support disputes at every stage, from cooperative settlements to high-conflict contested hearings.
Whether you are stepping into new independence or being asked to help support it, we handle California cases involving unequal income, disputed earnings, business income, compensation packages, bonuses, commissions, real estate income across California and the UK, hidden income concerns, and claims about each spouse’s ability to work or pay.
If you are already working with UK solicitors and your matter is being handled there, there may still be a California dimension that needs separate attention. A California asset, a spouse who earns income in the US, or a support order that will need to be enforced on this side of the Atlantic each requires California legal analysis that UK counsel cannot provide. We work alongside existing UK legal teams to handle the California side, so your solicitors have what they need to account for it in the UK proceedings.
Whether your matter sits between California and England & Wales, or extends to Scotland or Northern Ireland, our Beverly Hills team coordinates the California side. Contact us to schedule a Free Case Evaluation.
