What Does It Mean to Be Legally Separated?
Legal separation is a court-recognized status in which two married people live apart and divide their legal and financial lives, while remaining married under California law. The court issues orders that are fully enforceable. But when the case closes, you are still married. You cannot remarry. You may, in some situations, remain eligible for certain insurance or benefit plans, depending on the plan rules.
For some clients, that is exactly the point.

Reasons to Choose Legal Separation in California
There are several reasons that couples in California choose legal separation over divorce:
- No six-month California residency waiting period – Legal separation may be available if one spouse lives in California, even if the six-month California and three-month county residency requirements for divorce are not yet met
- Time to decide – Give yourself and your spouse space to determine if divorce is the right next step
- Health insurance – Keep a spouse covered under your plan if allowed, since the marriage remains legally intact
- Military benefits – Protect certain entitlements tied to marriage length under federal law
- Social Security – Preserve eligibility for some benefits based on a spouse’s earnings record
- Religious or personal beliefs – Formalize the separation when your faith or values don’t permit divorce
- Convert later – Amend the petition to divorce later
How Legal Separation Works in California
Legal separation follows nearly the same court process as divorce. Both begin with a petition, both address property, debt, support, and children, and both can be resolved by agreement or go to trial. The key difference is the outcome. Divorce ends the marriage. Legal separation does not.
Legal separation also requires both spouses to consent to that outcome under California law. Divorce, on the other hand, does not require the other spouse’s agreement. Under California Family Code § 2345, a court generally cannot enter a judgment of legal separation unless both spouses consent, with limited exceptions. If one spouse prefers divorce, that spouse can initiate the divorce process instead.
When it comes to residency, divorce requires six months in California and three months in the filing county. Legal separation does not require that six-month California residency period.
At least one spouse must currently live in California. Clients who have recently arrived in Los Angeles often file for legal separation first and may later amend the petition to request divorce once divorce residency requirements are met.
A legal separation can begin through the regular petition process or, for spouses who expect to agree on all final terms, through California’s joint-petition procedure.
Temporary orders can be put in place for support, custody, or use of the family home while the case proceeds. Both spouses then exchange full financial disclosures covering all assets and debts. Depending on the court and the case, settlement efforts or pretrial proceedings may occur before trial.
Uncontested separations can sometimes resolve more quickly than divorce because there is no six-month waiting period. Contested cases involving disputed assets, business valuations, or custody disagreements take longer.
Does Legal Separation Protect Your Assets?
In several important ways, yes.
In California, income earned, assets acquired, and debts incurred after the date of separation are often treated as separate rather than community, which can help create clearer financial boundaries going forward. But some assets or compensation tied to the marriage may not be received until later, which can change the analysis.
For example, stock awards granted during the marriage but vesting later may still need to be evaluated more closely, and agreements between the spouses can also affect how property or debt is characterized.
For business owners, that often means future business income or growth is less likely to be treated as community property once the date of separation is established. The analysis gets more complicated when a business existed during the marriage or includes both community and separate components.
For clients with inherited wealth, the proceeding can create a clearer record of when the marital economic relationship changed. How much of that inheritance stays separate property still depends on how it was held, used, or mixed with shared marital assets.
Legal separation also triggers automatic temporary restraining orders, known as ATROs. These prohibit both parties from transferring assets, spending down community funds, or changing beneficiary designations without court approval.
What legal separation does not do is shield you from debts your spouse incurred before the date of separation, or protect assets already commingled with community property during the marriage. Those questions require a case-specific analysis.

Yes. Legal separation leaves you legally married, which means you cannot remarry. Some clients find the open-ended status creates ongoing financial and emotional entanglement.
