Los Angeles Guardianship Attorneys

Temporary and long‑term guardianship representation across Los Angeles

What Does Legal Guardianship Mean?

Los Angeles Legal Guardianship Lawyers

At Provinziano & Associates, we work with grandparents, siblings, relatives, and trusted caregivers across Los Angeles who recognize that a child needs more than love. They need legal protection.

Some families come together quickly. Everyone agrees that guardianship is the right choice, and parents may even start the process themselves. We call this a cooperative guardianship, and it tends to move faster because there is no dispute for the court to resolve.

Other cases are more complex. A parent may resist the idea, multiple family members may seek guardianship at once, or someone may raise serious concerns about the child’s care or the fitness of a proposed guardian. These become contested guardianship matters, and they call for a different kind of preparation.

No matter the situation, our guardianship lawyers present your position clearly and advocate for an outcome that reflects your relationship with the child and supports their well-being.

Who Can Seek Guardianship

How Our Los Angeles Guardianship Attorneys Help You

Guardianship cases are successful based on strong preparation and a compelling case for why the child needs support and why you are the right person to provide it.

If you’re questioning a proposed guardian’s fitness or offering a better alternative, we help you build a case that gives the court reason to reconsider and puts the child’s true needs at the center of the conversation.

Here’s what we help with:

Establishing Guardianship

We help you pursue a general guardianship based on your relationship with the child and the care they need.

Our guardianship attorneys work closely with you to explain why guardianship is necessary, show your capacity to meet the child’s needs, and address any concerns the court may raise about stability, home environment, or long-term planning.

If the court orders an investigation or home visit, we help you prepare for it and coordinate the documentation the court requests.

Temporary Guardianship for Urgent Situations

If a child faces immediate risk because a parent is hospitalized, incarcerated, or otherwise unable to provide safety right now, California law allows a request for temporary guardianship on an expedited basis.

Our attorneys prepare the request, address the notice requirements, and present the facts supporting immediate appointment. If granted, a temporary guardianship generally lasts until the next scheduled hearing or until the court issues a further order on the general guardianship petition

If you also seek a general guardianship afterward, we represent you at the hearing where the court decides whether the arrangement should continue.

Guardianship for a Child With Special Needs

A child with a disability or significant medical need may require a responsible guardian. The proposed guardian may need to show how the child’s medical treatment, education, therapies, living arrangements, and other ongoing needs will be managed.

Our special needs guardianship attorneys help present those needs to the court and demonstrate the child’s capabilities and areas where support is needed.

Because guardianship ends when a child turns 18, we can also help families consider whether a limited conservatorship or a less restrictive alternative may be appropriate based on the individual’s abilities as adulthood approaches.

Challenging Guardianship

A parent may believe guardianship is unnecessary. A relative may agree that guardianship is needed but object to the person seeking appointment. Another family member may believe they are better suited to serve as guardian.

Our guardianship dispute attorneys represent parents, relatives, proposed guardians, and other interested parties in contested proceedings.

Depending on your position, we may challenge the need for guardianship, raise concerns about a proposed guardian’s fitness, defend against objections, or present evidence showing why you should be appointed instead.

Modifying and Terminating Guardianship

We help families respond to changing circumstances, including returning full legal rights to a parent, changing who serves as guardian, or adjusting the terms of the arrangement.

If the guardian’s situation has changed, the child is nearing adulthood, or reunification is appropriate, we guide you through the process to update or terminate the order.

Our team ensures your request is properly documented and presented with the clarity the court expects.

Joint Legal Guardianship

More than one person may be the right choice to share responsibility for a child. We help clients pursue or respond to joint legal guardianship, in which two guardians are appointed to share decision-making authority.

Courts remain cautious about granting joint guardianship unless there is strong evidence that both guardians are able to cooperate and consistently act in the child’s best interests.

When petitioning alongside a co-guardian or responding to a case in which joint guardianship has been proposed, we prepare filings that clarify roles and show how the arrangement supports the child’s stability.

Overview of Guardianship of Minors in California

Guardianship creates a legal framework that transfers certain rights and responsibilities to the guardian while leaving the door open for reunification if circumstances improve.

Under the California Probate Code, guardianship may include authority over the child’s daily care and decisions (guardianship of the person), responsibility for managing the child’s finances (guardianship of the estate), or both. One person may serve in both roles, or the court may appoint separate guardians to handle each responsibility.

Guardianship of the estate may be appropriate when a child has significant assets. California law provides simplified procedures for smaller amounts (typically $5,000 or less), and courts are more likely to require formal oversight as the value of the child’s estate increases.

A guardianship may also be limited, granting the guardian authority over specific decisions rather than full responsibility for the child, when that arrangement is a better fit for the family’s situation.

Some guardianships stabilize short-term crises. Many others continue for years, lasting until the child turns 18, unless the court finds it appropriate to end or modify the arrangement earlier.

How Guardianship Affects Parental Rights

Guardianship does not automatically end a parent’s rights. In most cases, it temporarily shifts day‑to‑day decision‑making to the guardian while parents remain the child’s legal parents, unless a separate proceeding later terminates parental rights.

Parents may petition the court to end or modify the guardianship if their situation improves. Courts weigh the parent-child relationship and, above all, the child’s best interests when deciding on reunification.

During the guardianship, parents may remain responsible for child support if the court orders it. Support is not ordered in every guardianship case, but the court may require it under California law.

Contested and Complex Guardianship Matters

Not every guardianship dispute has to end in a contested hearing. Some issues may be resolved through negotiation, mediation, or an agreement presented to the court for approval.

If an agreement is not possible, the case goes to trial, where a judge decides whether guardianship is necessary, who should be appointed, whether a guardian should be removed, or whether the arrangement should continue. We recommend litigation only when it becomes necessary.

Our guardianship litigation attorneys assess the available options, develop the evidence, prepare witnesses, respond to objections, and present the child’s needs and the proposed care arrangements to the court.

Guardianship vs. Conservatorship vs. Power of Attorney

The Provinziano & Associates Difference

Why Clients Choose Our Los Angeles Guardianship Law Firm

Your Privacy Comes First

Guardianship cases often involve sensitive family history, private struggles, or vulnerable moments. Some filings are public by law, but your privacy stays protected wherever possible, from how documents are filed to how the court and other parties are contacted on your behalf.

Prepare You for What Could Be Ahead

When you file the petition or respond to one, you always know what's coming next: legal notices prepared on time, documentation organized before it's needed, home study steps handled if required, and court concerns addressed before they surface. Guardianship cases move through specific legal stages, and staying ahead of each one keeps your case on track.

Your Case is Handled in the Language You're Most Comfortable Using

Your role in a child's life is on the line, and clarity matters. Multilingual staff is available in French, Italian, Spanish, Mandarin, Cantonese, Farsi, Armenian, and Russian, so nothing gets lost in translation. If your preferred language isn't listed, ask when you reach out.

Prepared for Agreement or a Courtroom Fight

Some families reach guardianship through agreement, and the process moves quickly. Other cases involve an objecting parent, competing relatives, or a dispute over what serves the child best and call for building a case that holds up in court. Our guardianship attorneys handle both, agreements that move smoothly through the court and contested cases that need to be litigated, bringing the same courtroom-tested preparation to each.

The Child's Well-Being Guides Every Legal Strategy

How we frame your case, what evidence we present, and which arguments we emphasize all center on the child's safety, care, and future. Courts want to see that decisions are being made for the right reasons. We make sure your case reflects that from start to finish.

FAQs
Guardianship in California

How Long Does Permanent Guardianship Last in California?

A guardianship in California usually continues until the child turns 18, unless the court ends it earlier.

A parent or another eligible person may ask the court to terminate the guardianship, but the court will decide whether ending it is in the child’s best interests.

Temporary guardianship usually lasts until the next scheduled court hearing or until the judge makes a decision on the general guardianship petition. It is designed as a short-term solution for urgent situations.

Under California Probate Code §1601, the court may terminate guardianship if ending it is in the child’s best interest. In practice, parents usually need to show that circumstances have improved sufficiently to make reunification safe and stable.

A grandparent petitions the probate court for guardianship by filing the required forms, giving notice to the child’s parents, and demonstrating to the court that guardianship serves the child’s best interests.

The court reviews the grandparent’s ability to provide a stable home, and in many cases, parents support the petition because they recognize the child needs the grandparent’s care right now.

Voluntary guardianship happens when a parent agrees to, and often starts, a guardianship arrangement for their child, usually because they are unable to provide care due to illness, deployment, incarceration, or another personal circumstance.

The parent and proposed guardian typically appear before the court together, or the parent signs a consent form, and the process moves faster than a contested case because there is no dispute for the court to resolve.

Yes, but the process is complex. Guardianship laws vary by state, and jurisdiction often depends on where the child has lived for the past six months and whether the case qualifies as a ‘child custody proceeding’ under the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA).

A lawyer helps determine which court has authority and how orders can be recognized or enforced across state lines.
This may require special filings or recognition of a California guardianship order in the other state, depending on where the child has lived for the prior six months.

A lawyer can guide you through interstate petitions and help with the recognition of court orders across state lines.

Proof of guardianship usually comes in the form of certified court documents, such as Letters of Guardianship issued by the court. These papers show schools, doctors, and government agencies that you hold legal authority to care for the child.

Your Next Move?

Most people wait too long to hire the right lawyer. You’re not most people.
