How California Handles International Child Custody Cases
When a custody dispute involves another country, the first questions are often which court can act, if the Hague Convention applies, and what options exist if it does not. Once those threshold issues are addressed, California courts apply the ‘best interest’ standard set out in Cal. Fam. Code sections 3011 and 3020, which require the court to prioritize the child’s health, safety, and welfare.
The courts will also consider any history of abuse, habitual use of controlled substances or alcohol, as well as the nature of contact with both parents.
When California Courts Can Act
California courts do not automatically have authority over every international custody dispute involving a California parent. Before a California court can make, change, or enforce a custody order, it must first determine whether California is the proper place for the case.
California courts use the UCCJEA, the Uniform Child Custody Jurisdiction and Enforcement Act, to decide many custody jurisdiction questions. Under California Family Code sections 3400 to 3465, the court may look at where the child has lived, whether California is the child’s home state, whether another court is already involved, whether there is an emergency, and whether California is an appropriate forum. For jurisdiction purposes, California generally treats foreign countries like U.S. states.
In cases involving Hague Convention treaty partners, the UCCJEA helps determine which court can decide or modify custody, while the Hague Convention addresses whether the child should be returned.
The Impact of the Hague Convention on International Child Custody
The Hague Convention on the Civil Aspects of International Child Abduction is an international treaty used in certain cross-border custody disputes involving children under 16. It applies when a child has been wrongfully removed from or retained in a country that signed the treaty.
The Convention does not decide which parent should have custody. Instead, it creates a legal process for determining if a child should be returned to the country of habitual residence (the country where the child lived on a settled basis) so that the proper court in that country makes the custody decision.
