Do You Qualify to File in California, and Should You?
To file in California:
- At least one spouse must have lived in California for six months (and in the filing county for three months)
- The other spouse does not need to be in California or the United States
Meeting those requirements means California courts may have the authority to hear your case.
Whether California is the right place to file is a separate question. Jurisdiction determines which country’s courts run your divorce and which laws decide what you walk away with.
Courts weigh where the couple last lived together, where assets are located, and where children reside. In some cases, different parts of the divorce are handled in different countries; one court may divide property while another handles custody.
