What French Clients Should Know About California Family Law

California family law uses different rules than those in France.

  • Residency: To file in California, either spouse must have lived in California for 6 months and in the filing county for 3 months.
  • No-fault divorce: California does not require proof of wrongdoing. Simply stating that the marriage has broken down and is beyond repair (irreconcilable differences) is sufficient.
  • Waiting period: California will not end marital status until 6 months after the other spouse is served, even if both spouses agree on all terms.
  • Support: Child support usually follows a statewide guideline formula. Spousal support depends on multiple factors, not a fixed percentage.
  • Property: California generally treats most marital earnings and acquisitions as community property, with exceptions for separate property and valid agreements.

FAQs: Paris-California International Family Law

Do I need both a California lawyer and a French avocat?
In many cross-border cases, yes. Each country has its own rules about jurisdiction, procedure, and how property and support are handled. A coordinated approach with counsel in both places reduces the risk of mixed messages and conflicting outcomes.
Often it can be, but it is not automatic. California courts look at whether the French court or process had proper authority, whether both parties had notice and an opportunity to participate, and whether applying the result would be consistent with California public policy. Any French judgment or agreement that touches California assets, income, or children should be reviewed by a California attorney.
These documents are important, but they do not automatically control what a California court will do. They are part of the story, not the whole story. Before you assume that a French contract or judgment fully protects you (or fully exposes you) in California, have both French and California counsel review it in the context of your current life.
Yes. Adultery can still be used as a fault ground in France under “divorce pour faute,” where a spouse asks for divorce based on a serious or repeated breach of marital duties, including infidelity. In practice, most French divorces are now no-fault or by mutual consent, and only a minority proceed on fault grounds such as adultery.
