Services Our Los Angeles Child Custody Lawyers Provide
Child Custody & Visitation Orders
You want to be there for bedtime stories, school pickups, and the moments that shape your child’s life.
Our child custody and visitation attorneys help parents pursue joint custody, sole custody, or supervised visitation arrangements. We focus on clear decision-making rights and meaningful parenting time that protects the bond only you can have with them.
For executives and professionals in finance, technology, media and entertainment, healthcare, law, and other demanding fields, we help pursue and protect custody and visitation rights when long hours, travel, changing schedules, or other professional demands become part of the dispute.
Temporary Custody Orders
Even while your case is still in progress, your child’s life can’t be put on hold. They still need a steady routine, a sense of home, and the comfort of knowing what to expect tomorrow.
We help parents request or respond to temporary custody orders when early structure is needed to protect a child’s routine, reduce conflict, or address immediate parenting concerns.
Emergency & Urgent Custody Concerns
Sometimes, waiting is not an option.
If your child faces immediate safety concerns or risk of wrongful removal, our child custody attorneys help you respond quickly while keeping your child’s safety, stability, and best interests at the center of the case.
When a Parent Wants to Move
A proposed move can affect school, routines, travel, and each parent’s time with the child.
Our custody team represents parents in California move-away cases, including parents who need to relocate and parents opposing a move that could limit their time or disrupt their children’s stability.
Enforcement of Custody Orders
A custody order only works if it is followed. When the other parent withholds time, changes schedules without agreement, refuses exchanges, blocks communication, or ignores decision-making terms, it’s not just frustrating; it can hurt your relationship with your child.
Our attorneys help parents present enforcement issues to the court, request make-up parenting time or sanctions when appropriate, and restore the parenting schedule your child depends on.
Parental Abduction & Child Recovery
When a child is kept or taken in violation of a court order, every hour counts.
We act quickly through California courts, law enforcement, and, if necessary, international treaties to bring children back to the home and routine the court has ordered.
Modification of Custody
Life changes. Jobs, schools, and children’s needs evolve.
We help parents request or oppose changes to custody orders so the plan matches the reality of your child’s life today, not the way things looked years ago. We also help determine whether the issue is really a modification problem, an enforcement problem, or both.
Special Needs Child Custody
When a child has special needs, custody decisions must go beyond standard schedules. Therapy sessions, medical appointments, specialized schooling, and daily care routines all need to be factored into the plan.
Our child custody lawyers help parents present these realities to the court and advocate for custody orders that reflect the child’s special needs.
Additional Custody Situations We Handle
Some custody cases involve safety concerns, complex family structures, or jurisdictional questions that require a different approach from the start.
Our Los Angeles child custody attorneys also represent parents in matters involving:
- Family structure and parental rights — parentage disputes, fathers’ rights, grandparents’ rights, same-sex parents, and broader LGBTQ family law matters.
- Safety and high-conflict situations — domestic violence, supervised visitation, parental alienation, estrangement, and high-conflict co-parenting.
- Jurisdiction and logistics — military custody, interstate custody, international custody, and custody issues tied to child support.
Each of these situations changes what needs to be proven, how orders should be structured, and what the court will weigh most heavily. Our role is to connect the facts of your family’s situation to the custody outcome the court can actually order.
Child Custody Litigation
When parents cannot reach an agreement, custody issues may need to be decided by the court.
Our Los Angeles child custody litigators build a strong evidentiary record, respond to disputed allegations, and present the case to support custody orders grounded in the child’s needs and California’s best-interest standard.
A few months ago, I had to hire an attorney for a child custody matter. I came across Provinziano & Associates through a Google search and chose this firm because of their great reviews and high ratings. I’m glad I did; my attorney, Alphonse F. Provinziano, was able to get everything done fairly quickly, and I got child custody in my favor. I would recommend him to friends and family.

Child Custody in California: What the Court Looks At
California custody law is built around one principle: every decision the court makes must serve the child’s best interests, with their well-being, health, and safety as the top priority.
Courts also start from the view that children generally benefit from frequent and continuing contact with both parents, as long as that contact is safe.
What the Court Weighs
Judges apply the “best interests” factors in Family Code § 3011 and related sections when deciding custody and parenting time.
Key considerations include:
- Safety concerns: Any history of abuse, domestic violence, credible threats, or substance issues that affect parenting.
- The child’s routine and stability: School, home life, and which parent has been handling the day‑to‑day care.
- Each parent’s ability to meet the child’s needs: Food, housing, medical care, schooling, and emotional support, based on actual patterns, not just promises.
- Co‑parenting behavior: Whether each parent is willing to support the child’s relationship with the other parent when it is safe to do so.
When there is a finding of domestic violence, Family Code § 3044 creates a strong presumption against awarding custody to the parent who committed it.
In cases with safety concerns, courts may order supervised visitation, meaning parenting time takes place with a neutral third person present until the court is satisfied the child can be kept safe.
What Custody Terms Mean in a Child Custody Court Order
In California, custody can involve both decision-making authority and where a child lives:
- Legal custody – the right to make important decisions about your child’s upbringing, including education, healthcare, and major activities.
- Physical custody – where your child lives and how their time is divided between parents.
Custody can be:
- Joint – Parents share legal custody, physical custody, or both.
- Sole – One parent has primary decision‑making, primary physical time, or both.
Some families have joint legal custody with primary physical custody to one parent, while others use tailored schedules that fit a child’s age, school schedule, and specific needs.
Before a Judge Decides Custody in Los Angeles
In Los Angeles County, contested custody and visitation matters often involve steps before the judge makes a final decision.
In Los Angeles custody and visitation matters, parents are generally required to complete Our Children First, the Los Angeles Superior Court’s mandatory online orientation, before their hearing. When custody or visitation is contested, parents usually attend Family Court Services mediation before the judge hears the dispute.
The mediator is a court employee who helps the parents try to reach an agreement. If they do, the agreement can become a court order without a contested hearing. If they do not, the case proceeds to a custody hearing or trial.
In more complex cases, the court may order a Parenting Plan Assessment, a structured review conducted by a Family Court Services specialist, or a Section 730 custody evaluation, a more detailed assessment typically conducted by a mental health professional appointed by the court. These assessments give the judge more information to consider before deciding custody or visitation.
Our team helps clients prepare before the evaluations and respond after them, including organizing the records evaluators rely on, clarifying the parenting plan proposal, and addressing the report and recommendations in negotiations or at a hearing when needed.
Thanks to Provinziano’s coaching for my Parenting Plan Assessment (PPA), I was granted joint physical and legal custody of my son. His experience and dedication gave me the outcome I hoped for and someone I could trust every step of the way.
