Spain-California Family Law Attorneys in Beverly Hills
California Counsel for Divorce, Custody, Support, and Property Division Matters Involving Barcelona and across Spain
You might live in one country while your spouse remains in another, or you might have a divorce judgment, convenio regulador, support order, or custody arrangement from one country that now needs to be recognized or enforced in the other. In more urgent cases, a child may have been removed or retained across borders without the other parent’s permission.
These are among the situations we regularly encounter in Spain-California family law disputes.
Provinziano & Associates represents clients in Spain-California divorce and related family law cases, with a particular focus on matters connected to Barcelona and other parts of Catalonia. We lead the California case and work with trusted Barcelona counsel when the matter also requires advice, local filings, or representation under Spanish family law, including under Catalan civil law.
Our team brings more than 100 years of combined experience handling California family law matters, including several cases with Barcelona and California dimensions.
Alphonse Provinziano, our managing partner, is a Certified Family Law Specialist and a Fellow of the International Academy of Family Lawyers, a global network of experienced attorneys who handle international family law cases.
Who We Help
Our clients include Spanish nationals who built careers or families in California, Californians who may have married into a family rooted in Barcelona, and dual nationals whose lives never fully settled on one side.
Get advice before your next step if any of this sounds familiar:
- You live in California while your spouse remains in Barcelona or elsewhere in Spain
- You have property, a business, a pension or other assets split between Spain and California
- Children who split time between the two regions, or a parent considering relocation
- An existing Spanish separation agreement, divorce judgment, or capitulaciones matrimoniales (a Spanish marriage contract) that needs enforcing or recognition
- Not knowing where to file first between California or Catalonia
- A spouse who has filed, or threatened to file, in Spain while living in California, or the reverse
If your case is connected to another part of Spain rather than Catalonia, we also assist with California family law cases connected to other regions of Spain.
We Speak Your Language
International family matters often cross language lines.
Our attorneys primarily work in English, but we offer support in French, Italian, Spanish, Mandarin, Cantonese, Farsi, and Russian.
If you prefer to communicate in another language, contact us and we’ll confirm what’s available for your situation.
What You Should Know About Spain-California Family Law
California and Spain do not approach every family law issue in the same way. Spain also has several autonomous communities with their own civil laws, particularly in areas such as matrimonial property. Because Barcelona is in Catalonia, cases connected to the city may require analysis under Catalan civil law depending on the parties’ personal and family circumstances.
This may affect the matrimonial property regime, compensatory support, marital agreements, and property rights. However, a Barcelona address alone does not determine which law applies. The analysis may depend on vecindad civil (regional civil-law status), nationality, habitual residence, where the spouses first lived after marriage, and any capitulaciones matrimoniales (marital property agreements).
Divorce jurisdiction:
California generally requires one spouse to have lived in the state for six months and the filing county for three months. In Spain, jurisdiction is generally based on habitual residence and, in some cases, nationality.
Divorce:
Both California and Spain allow no-fault divorce. In Spain, a divorce generally cannot be filed until three months after the marriage, subject to limited exceptions.
Child support:
Both systems consider the child’s needs and the parents’ financial circumstances. California applies a statewide guideline formula, while Spanish courts have more discretion and may consult advisory tables.
Custody:
Both systems focus on the child’s best interests. In an international custody dispute, the child’s habitual residence may determine which country has authority to decide custody and visitation.
Spousal support:
California may award support after weighing a broad set of statutory factors. In Spain, compensatory support may be available when the breakup creates an economic imbalance for one spouse and worsens that spouse’s financial position from during the marriage.
Property division:
California generally treats earnings and assets acquired during marriage as community property, with the community estate usually divided equally at divorce. Catalonia generally follows separacio de bens, under which each spouse keeps property owned separately, while jointly owned assets are divided according to their ownership shares.
How We Work With Our Barcelona Colleagues
Through the International Academy of Family Lawyers, we have established relationships with experienced attorneys in Barcelona and elsewhere in Spain. Our established Barcelona colleagues bring us in when a Spanish family law case involves California, and we bring them in when a California case requires advice or court action under Spanish national law or Catalan civil law.
If you already have an attorney in Spain, we work alongside that attorney rather than replace them. Provinziano & Associates handles the California case while Spanish counsel handles Spanish law and proceedings, with both teams aligning the strategy, timing, filings, and other steps that may affect the case in either country.
For marriages connected to other Spanish regions, we coordinate with local counsel to address community-property or other applicable regimes under that autonomous community’s law.
Barcelona-California Family Law Services
Deciding Where to File
We assess the risks and advantages of each available forum before filing. Depending on the case, different issues may need to be addressed in different countries or courts.
Before recommending where or how to proceed, we identify which courts may act, which law may govern each issue, what Spanish civil-law regime may apply, and what steps are required for orders and documents to have effect in both countries.
Barcelona-California Divorce and Separation
Our family law attorneys represent spouses and registered partners in contested and uncontested international divorce, legal separation, and annulment proceedings.
When proceedings are also required in Barcelona, we coordinate with Barcelona counsel on a divorcio de mutuo acuerdo (divorce by mutual agreement), divorcio contencioso (contested divorce), or related action.
We also coordinate service of process, apostilles, certified translations, and other documents needed for use in both countries.
Cross-Border Spousal Support and Prestación Compensatoria
We represent clients seeking cross-border spousal support (prestación compensatoria) and those contesting excessive claims, addressing the amount, payment structure, and duration.
California and Catalonia may award support for a defined period when eventual self-sufficiency is realistic, although California may award longer-term support after a long marriage.
We present evidence of financial need, sacrifices made during the marriage, and each party’s actual financial position.
Barcelona-California Child Support (Pensio d'Aliments)
We represent parents seeking child support, contesting an amount that does not reflect their financial circumstances, or seeking to modify an existing order as circumstances change.
California uses a statewide guideline formula, while courts in Spain have more discretion. We present accurate income, expenses, parenting arrangements, and the child’s needs to pursue a fair and workable support order.
International Custody, Visitation, and Hague Convention Matters
We represent parents in cross-border custody, visitation, and relocation cases involving California and Spain, particularly Barcelona and other parts of Catalonia. These cases may involve legal and physical custody, schedules that must work across countries and time zones, and proposed moves between California and Spain.
When a child has been wrongfully removed or retained, we coordinate with the appropriate Hague Convention authorities to seek the child’s return or defend against a return petition.
Property and Assets in California and Barcelona
We identify which law or marital agreement may apply, and when Spanish or Catalan civil law is in play, we confirm that analysis with Barcelona counsel before determining what each spouse may own or claim. This may involve California community property rules, Catalonia’s separacio de bens (separation of property), capitulaciones matrimoniales (marital property agreements), or another applicable Spanish civil-law regime.
We then work with specialists if needed to trace, value, and address cross-border assets such as real estate, business interests, pensions, accounts, intellectual property, and digital assets.
We also investigate concealed income and assets and coordinate with Spanish counsel when action is required in Spain.
Recognizing and Enforcing California and Spanish Orders
A custody, support, or property order from one country may need to be formally recognized before it can be enforced in the other. We handle recognition and enforcement of cross-border orders in California and coordinate with Spanish counsel for proceedings in Spain.
We also manage practical requirements, including certified translations when needed and any additional steps required for recognition or enforcement.
California and Catalan Marriage Contracts, Prenups, and Postnups
We draft California prenups and postnups and coordinate with Barcelona attorneys on separate Spanish or Catalan capitulaciones matrimoniales (marital agreements) designed to work alongside them. These coordinated or mirror agreements help align the parties’ intentions so the same terms hold up on both sides.
We also review agreements before signing, and represent clients on both sides of a dispute, defending a valid prenup or challenging one signed under pressure, incomplete disclosure, or unfair terms.

The Provinziano & Associates Difference
Why Clients Choose Our Spain-California Family Law Firm
We Coordinate Your California and Barcelona Attorneys for You
You do not have to manage separate attorneys, conflicting advice, or filings in two countries. We coordinate the California side with attorneys from our established Barcelona and IAFL network. You can choose the Barcelona attorney you want to work with, and no one is brought into your case without your permission.
Spain-Specific Asset Strategy for Complex, High-Stakes Cases
We address Spanish S.L. and S.A. interests, family holding companies, Barcelona real estate, usufruct and bare ownership interests, inheritances, investment accounts, and assets subject to Catalan property rules, in coordination with Spanish counsel and financial experts. We develop a coordinated strategy for tracing, valuing, dividing, and protecting assets connected to both Spain and California.
Discreet Options That Limit Unnecessary Public Exposure
Some court records and proceedings cannot be kept private. Where the law allows, we seek confidentiality protections and limit unnecessary disclosures to reduce exposure of sensitive financial and family information.
Negotiation Strategies Focused on Resolution, Not Conflict
Court is not our automatic first choice. When the facts and both sides allow, we use direct negotiation, mediation, and private settlement processes to protect your position without creating unnecessary conflict. The goal is a workable resolution that still reflects your priorities and protects your rights.
Trial and Appellate Experience When Settlement Is Not Enough
When litigation becomes necessary, we are prepared to advocate for you in court while coordinating any related Spanish proceedings with Barcelona counsel. We also preserve important issues and deadlines from the beginning so appellate options remain available if a California ruling needs to be challenged.
Access to Cross-Border Expert Witnesses
When a case requires specialized evidence, we work with qualified expert witnesses in areas such as forensic accounting, business and real estate valuation, asset tracing, tax, and child-related issues. We select experts based on the needs of the case and help align their work with the California and Spanish issues involved.
How Our Barcelona-California Family Law Team Works With You
1. Schedule a private case evaluation so we can review the California and Spain connections, identify the immediate legal issues, and determine how our team may assist.
2. After you hire us, we develop the initial strategy and, with your permission, bring in trusted Barcelona counsel if Spanish legal advice or representation becomes necessary as the case develops.
3. We coordinate with Barcelona counsel and communicate with the other side or opposing counsel to evaluate settlement options, address issues arising in each country, and determine the strongest course for your case.
4. We represent you through mediation, private settlement discussions, court proceedings, or litigation, depending on what the circumstances require and which approach best protects your interests.
5. After judgment, we remain available for enforcement, modifications, appeals, and other issues that may arise in California or require coordination with counsel in Spain.
