Elite California Executive Divorce Attorneys
Specialized Divorce Counsel for Founders, C-Level, and Senior Leaders Across Tech, Business, Media, and Entertainment
In an executive or senior role, your work can become evidence once a divorce starts. The availability or flexibility associated with an executive role may be exaggerated, while financial discovery may expose compensation details or confidential company information never intended for outside review.
Irregular schedules, travel, and after-hours responsibilities may also be used to question how much time you can realistically give your children.
Provinziano & Associates is an elite Los Angeles family law firm representing senior professionals and industry leaders in contested and uncontested executive divorces throughout California, where professional responsibilities and complex business interests intersect with the family law issues at stake.
The firm is led by Alphonse F. Provinziano, a former prosecutor and Certified Family Law Specialist certified by the State Bar of California. His family law experience includes cases involving significant financial and business interests alongside matters relating to children in divorces.
While our firm represents senior leaders across major industries, we have particular depth in the financial architecture of the Technology, Media, and Telecommunications (TMT) sectors, including entertainment businesses.
Whether working with traditional corporate structures or at platforms like Amazon, Meta, Netflix, and Google, our clients face complex compensation frameworks that make divorce analysis far more technical than a standard salary-based case, particularly when significant value sits in equity, contingent compensation, or rights that have not yet produced liquid cash.
Call (310) 820-3500 to speak with our Los Angeles executive divorce attorneys about protecting your compensation, company interests, parenting priorities, and long-term financial position.

Property Division in a California Executive Divorce
California generally treats property acquired during marriage as community property, while property owned before marriage or received by gift or inheritance is usually separate.
Executive compensation and company interests may include both community and separate components depending on when and how the rights were acquired.
Executive Compensation Packages in Divorce
Executive compensation is a complex architecture of variable income, ownership interests, liquidity restrictions, and long-term incentives including equity, bonuses, deferred compensation, supplemental executive retirement plans (SERPs), profit participation, residuals, royalties, and other contingent income.
How each component is treated in divorce depends on when it was earned, what it was intended to reward, and when the value becomes available.
In divorces with executive compensation, our attorneys look beyond the payment date to the underlying contract terms and performance periods to determine how each component is treated, including what portion may be community or separate property and whether it also counts as income available for spousal or child support calculations.
We dissect these sophisticated packages based on three primary factors:
- Characterization: Identifying when the compensation was earned to determine what portion may be community property and what portion may be separate property after separation.
- Contingencies & Timing: Evaluating what corporate milestones or vesting conditions must be met before value is unlocked, and determining whether to value the asset now or divide it if and when it is received.
- Future Allocation: Addressing how unknown or contingent future payouts, such as post-divorce bonuses or profit shares, will be calculated, documented, and structurally allocated, including whether percentage-based supplemental support is appropriate when such income is received after divorce.
If the case calls for deeper financial analysis, we bring in the appropriate specialists to examine it and support the case.
Equity Awards and Vesting
Executive equity packages—including restricted stock units (RSUs), incentive stock options (ISOs), and nonqualified stock options (NSOs)—carry complex tax structures, forfeiture terms, and transfer restrictions.
When an award rewards work performed both during the marriage and after separation, California courts commonly use time-based formulas to determine the community and separate property portions.
Because unvested equity is difficult to assign a present cash value, these assets are often divided later when they vest, are exercised, or yield a return.
Private-company shares require a different analysis. A valuation prepared under Section 409A of the Internal Revenue Code, commonly called a 409A valuation, generally estimates the fair market value of a private company’s common stock for equity-compensation purposes.
That figure may differ from the value of a founder’s ownership interest in divorce, where share classes, financing rounds, ownership rights, and transfer restrictions may also matter.
Company Transactions and Liquidity Events
A pending divorce can be significantly disrupted by a funding round, initial public offering (IPO), mergers and acquisitions (M&A) activity, corporate restructuring, or sale.
These corporate shifts can dilute ownership stakes, alter vesting schedules, or trigger substantial retention payments. They may also instantly convert existing awards into cash, new shares, or replacement compensation.
Our attorneys actively track these corporate events to safeguard your interests. Because a sudden change in control can drastically alter both the overall value of the community estate and the income available for support calculations, we ensure these real-time fluctuations are accurately reflected in your property division and support structures.
Taxes and Double Counting
Executive compensation can create different tax liabilities when it vests, is exercised, paid out, or sold, depending on the type of compensation.
Any strategic division must consider these tax implications, the timing of taxable events, and how taxes may affect the amount the recipient ultimately retains.
High-asset divorces also require careful analysis of how compensation is treated in property division and support calculations. The same equity award may be divided as marital property while income from that award is also considered for support.
Our attorneys examine how each award is valued and how the related income is calculated to identify potential double counting, address any discrepancies, and reduce the risk of post-judgment disputes.
Whether your compensation includes equity, deferred pay, profit participation, royalties, or income tied to a liquidity event, call (310) 820-3500 to speak with our team about how it factors into your case.
Founder Interests and Private Company Ownership
For founders and business owners, a major concern is preserving control of the company and avoiding an ongoing ownership relationship with a former spouse. Even if the other spouse never worked for the company or held shares in their own name, they may have a community property claim to some or all of the value acquired during the marriage.
That does not necessarily mean shares must be transferred to the other spouse. The founder may retain the shares while the other spouse receives equivalent value through a buyout, other property, or payments over time.
The analysis is different when the other spouse already holds shares or is a documented co-founder or co-owner. Their direct ownership rights must be addressed separately from determining which portions of each spouse’s interests are community or separate property.
If the company began as one spouse’s separate property, the analysis may also need to look at its later growth. This means determining how much growth is attributable to that separate interest, and how much resulted from work or community funds contributed during the marriage.
If both spouses will continue holding shares, we structure negotiations to address voting rights, distributions, access to company information, and transfer restrictions. This keeps both governance and exit expectations clear if the shares are eventually sold.
Intellectual Property (IP), Content Rights, and Proprietary Technology
Divorce frequently creates complex disputes over intellectual property, digital content rights, proprietary technology, and specialized licensing agreements. These assets may be personally owned, assigned to a corporate entity, licensed out to third parties, or embedded directly into a scaling business.
The critical legal objective is determining who owns the underlying rights: the individual, the company, or the marital estate. Often, the marital estate has an interest in the value produced, not necessarily the core IP itself, but there are exceptions.
We collaborate with intellectual property and valuation specialists to isolate personally held rights and future income streams from corporate-owned assets and overall business value.
Cross-Border Careers and Overseas Assets
At this level, careers often span global borders, involving compensation, accounts, property, or incentive plans administered by foreign subsidiaries. These cases may require foreign tax and currency analysis, review of overseas financial records, and coordination with financial institutions, employers, or other parties where appropriate.
International jurisdictions also introduce enforcement challenges. Our legal team evaluates whether California orders may be recognized or enforced abroad, whether foreign judgments may be enforced in California, and how differences between legal systems could affect property division, support, or other financial obligations.
Led by a Fellow of the International Academy of Family Lawyers, our team coordinates with foreign family law attorneys and other outside counsel when multiple countries’ laws intersect.
Depending on the case, we also work with international tax advisors, forensic accountants, valuation specialists, and immigration counsel to address foreign compensation, tax exposure, residency concerns, and cross-border financial obligations.
Other Significant Assets in an Executive Divorce
Beyond your compensation and company interests, we handle the bigger asset and income picture, including real estate, investment and retirement accounts, trusts, and other family wealth.
If your case involves substantial assets or income, our high-net-worth divorce services address this in more detail.

Related Family Law Services for Executives
Our California executive divorce lawyers also help you address custody, support, relocation, and other issues shaped by demanding careers and nonstandard compensation.
Custody and Visitation: Putting the realities of senior leadership into context, so constant travel, product launches, or production cycles are not mistaken for parental disinterest and remote work mistaken for unlimited childcare availability.
We seek custody and parenting time arrangements that secure meaningful time with your child and preserve your voice in major decisions while accommodating the operational demands of your role.
Move-Away and Relocation: Representing parents when a new role, return‑to‑office mandate, corporate relocation, acquisition, or other career change requires a move across state lines or internationally.
We also litigate and negotiate against relocations that would substantially disrupt your relationship with your child, focusing on their stability and maintaining frequent contact.
Spousal Support: Addressing support when executive compensation fluctuates, vests, or is paid over time, as well as whether and when the supported spouse can reasonably become self-supporting.
This may include coordinating support property buyouts and timing lump-sum payments around liquidity events.
Child Support and Variable Income: Addressing guideline support when substantial income fluctuates or when a parent may qualify as an extraordinarily high earner. Courts may use percentage-based add-ons for bonuses and other variable income.
Our goal is to ensure your child’s needs and accustomed standard of living are properly considered based on a reasonable assessment of the income available for support.
Prenuptial and Postnuptial Agreements: Enforcing or challenging existing terms in your agreements.
If an agreement places a client at a substantial disadvantage, we assess its enforceability and negotiate over how its terms should be applied or whether the parties can reach a different financial settlement.
Confidential Company Information in Divorce
Divorce discovery frequently targets confidential company data, but this does not make every internal corporate document legally relevant.
Our discreet approach to executive divorce representation extends to the discovery process. Our attorneys work to limit requests to information relevant to the issues being litigated and challenge those that are unnecessarily broad, burdensome, or intrusive.
If a case involves trade secrets, proprietary technology, or other sensitive company information, we may seek protective orders, targeted discovery, confidentiality agreements, or other court-permitted protections to limit unnecessary disclosure.
When sensitive information belongs to an employer, investor, or overseas affiliate, we may also coordinate with company counsel and other legal specialists to address contractual confidentiality obligations, trade secrets, and applicable data protection requirements.
How We Handle Executive Divorce: Strategic Dispute Resolution
A professionally complex divorce is not a single-track process; it requires a flexible strategy that adapts as financial information, negotiations, and legal positions evolve.
We negotiate when a private, well-structured agreement maximizes your advantage, and we litigate aggressively when transparent financial disclosure, fair terms, or your fundamental rights are compromised.
Our firm treats litigation as a calculated tool, not a default reaction. Depending on your privacy goals and corporate risk tolerance, we utilize direct negotiations, mediation, private binding arbitration, or courtroom litigation.
We tailor the dispute framework entirely to the specific leverage points of your case, refusing to generate unnecessary friction, artificial conflict, or public exposure that fails to advance your strategic outcome.
If you are a business, corporate, entertainment, or other executive facing divorce or high-stakes family law issues in California, call our executive divorce attorneys at (310) 820-3500 to schedule a private and confidential case evaluation.
The Provinziano & Associates Difference
Why Executives Choose Our Los Angeles Family Law Firm
Certified Family Law Specialist-Led Representation
Our team is led by a Certified Family Law Specialist, a certification held by a small share of California family law attorneys and focused entirely on this area of practice. He also serves as President of the Beverly Hills Bar Association, reflecting his leadership and involvement in California's legal community.
Limiting Workplace Disruption
For senior execs, a contentious divorce can affect leadership credibility, board or investor relationships, client confidence, and even the company’s public image. Where appropriate, we pursue private resolution and keep unnecessary allegations and third parties out of the dispute. If the case requires a more assertive approach, we adjust accordingly. The goal is to resolve the family law issues without allowing the divorce to create avoidable professional fallout.
Proven Courtroom Experience
Some family law cases settle, but when trial becomes unavoidable, you want attorneys who know their way around the courtroom. With more than 3,000 family law cases handled and over 300 trials completed firm-wide, we have the experience to present your case in court, giving you confidence even in the most contested situations.
International Family Law Leadership
Alphonse regularly presents alongside judges, academics, and leading family law practitioners at international conferences and professional programs. His work includes discussions on cross-border enforcement, digital and emerging asset classes, and Hague Convention cases, bringing current international insight to families whose lives and finances extend beyond California.
